SECTION 1418 EXCAVATIONS AND FILLS
No excavation over four hundred (400) square feet in area or twenty-five (25) cubic yards may occur within the Township without a building permit issued by the Zoning Officer. The Township finds that uncontrolled excavation without reasonable and proper conservation measures is a major threat to the ability of soil to sustain vegetation, the continued ability of streams and waterways to harbor life, and the recovery of streams and water ways from which life has previously been extirpated. Gardening or normal farm tillage do not require excavation permits.
A. Excavations within the Township shall only be conducted according to the following conditions.
1. All excavated areas shall be mulched andreseeded with appropriate vegetation within three months of the excavation.
2. No open pits of greater than 15 feet in depth shall be maintained for more than one twentyfour hour period unless such area is fenced to prevent children from falling in and marked every twenty feet by flashing lights which operate between one half hour before sunset and one half hour after sunrise.
3. Any pile of soil or other excavated material excavated for future use shall be protected from erosion by:
a. Where pile is to be reused within 30 days by a tarp, or
b. Where pile is to be reused in more then 30 days by establishment of a vegetative cover and temporarily covered completely by mulch during revegetation.
4. All applicants for an excavation permit shall be accompanied by a soil and erosion conservation plan on forms provided for by the Township indicating scope and sequence of operation. Excavations greater than 1 acre shall be submitted to the Cambria County Conservation Service for comment at least 30 days prior to application.
5. Excavation shall include road building activities greater than 100 feet in length whether temporary or permanent and the construction or reconstruction of stream crossings.
6. All applicants shall to the maximum extent feasible take steps and precautions to prevent the erosion of soil away from the excavation site.
7. The reclamation requirements of this Section shall apply to any excavation existing in the Township on the effective date of this Ordinance.
8. A copy of an erosion and sedimentation control plan shall be submitted with application.
B. Fills over twenty-five (25) cubic yards in volume require a permit. No fill shall be placed on slopes exceeding twenty-five (25) percent except by variance. Application for the variance shall require submission of a plan showing how the fill and underlying ground is to be stabilized to prevent slumping, slippage or landsliding.
