AN ORDINANCE OF CONEMAUGH TOWNSHIP, CAMBRIA COUNTY ESTABLISHING A LICENSE FEE AND MINIMUM STANDARDS FOR PERSONS ENGAGED IN CONSTRUCTION ACTIVITIES WITHIN THE TOWNSHIP AND ESTABLISHING A PENALTY FOR VIOLATION THEREOF.



Whereas, Conemaugh Township has adopted ordinances regulating construction in the form of building permit, zoning, subdivision, flood plain and stormwater management as well as others of less general application, and,

Whereas, in isolated instances, contractors have performed work, without obtaining necessary township permits, or without compliance with state laws and regulations regarding workers insurance, or proper disposal of construction waste, and,

Whereas, the township desires to protect itself and its residents by establishing a comprehensive system of licensing of contractors within the township.

Now Therefore, be it ordained and enacted this 7 day of July, 1997, upon advertisement and deliberation at a public meeting, the Conemaugh Township Supervisors hereby adopt the following ordinance requiring all contractors to obtain a license and to as a condition thereof to demonstrate compliance with minimum standards set out below.

1) Definitions

Contractor - any person or corporation engaged in performing any construction service to a third person, not a mother, father, brother or sister, or child.

Construction Service - shall mean any of the activities commonly referred to as construction and shall include without limiting thereby, plumbing, heating, roofing, interior remodeling, excavating.

2) Prohibition

No Contractor shall perform construction services within Conemaugh Township, Cambria County without first obtaing a Contractor's license

3) Contractor's License

Any Township officer responsible for zoning and building permits shall have the authority to issue a contractor's license upon presentation by a contractor of the following information and tendering of the fee set forth in the schedule below, or as modified by future Resolution of the Township Supervisors. Licenses shall be valid for one calendar year, from January 1 or each year.

a) An applicant for contractor's license shall fill out a form approved by the supervisors for the purpose of obtaining the license required by this ordinance.

b) The applicant shall provide proof of workmen's compensation insurance, and public liability insurance in an amount of at least ($50,000.00) fifty thousand dollars. The Township shall be a listed certificate holder on the insurance mentioned. In the event that an insurance certificate is canceled, the license shall become ineffective until such time as a new certificate is provided to the Township.

4) Schedule of Fees

Contractor's shall submit a fee, of ($25.00) twenty-five dollars, or such other amount as the Township Supervisors may set by Resolution from time to time.

5) Display of License

Contractor's performing construction services within the township shall display a copy of their current license at the work site in a location where it is visible from the home or business entrance or in the case of new construction at the entrance to the work area. It shall be the contractor's duty to see that the license remains intact and readable during the duration of the construction services.

6) Pursuant to Act 172 of 1996, a violation of this ordinance shall constitute a summary offense, and separate violations will be deemed to occur on each day that a the contractor remains in violation. The following is the schedule of maximum fines established by this ordinance;

a) for violation of section prohibiting a contractor from performing construction services without first obtaining a contractors license, no more than $1,000.00 for each and every day that the violation continues.

b) for violation of section 3 b) performing contracting services without required insurance, no more than ($750.00) seven hundred and fifty dollars for each and every day that the violation continues.

c) for violation of section 5 requiring the license to be displayed continually at the work site, no more than ($500.00) five hundred dollars for each and every day that the violation continues.

7) The provisions of this act are intended to be severable.

Adopted on the date set forth above and effective in 60 days from the date of adoption..
